Travel Booking Terms & Conditions

These Terms & Conditions constitute the entire understanding and agreement between you and The Joy of Travel Ltd. (“The Joy of Travel”) with respect to any and all bookings, tours, or travel transactions made through us.
By providing your credit card, signing, or electronically accepting a booking, you acknowledge that you have read, understood, and agree to be legally bound by The Joy of Travel’s Terms & Conditions and the applicable supplier’s terms of sale. You expressly authorize The Joy of Travel Ltd. to act on your behalf in arranging and performing the services booked. All persons named in the booking are subject to and bound by these Terms & Conditions. You represent and warrant that you have informed all other participants listed in the booking of these terms and that each participant has read, understands, and agrees to be bound by them.
ABOUT US
The Joy of Travel Ltd. is an Ontario-registered travel retailer (TICO Reg. #2472491 / 2171876) operating in accordance with the Travel Industry Act, 2002 and Ontario Regulation 26/05. We act as an agent on your behalf in arranging travel services provided by independent third-party suppliers including airlines, hotels, cruise lines, tour operators, and ground operators. In accordance with the Travel Industry Act, 2002, all client funds received by The Joy of Travel Ltd. are held in a designated Trust Account and are used solely for the purpose of the travel services booked on your behalf.
The Joy of Travel Ltd. charges a service fee for travel counselling and booking services. Service fees vary depending on the nature and complexity of the booking and will be disclosed to you prior to booking. Please note that service fees are non-refundable regardless of whether you proceed with the booking.
DEPOSITS & PAYMENT
A deposit may be required at time of booking and is non-refundable unless otherwise specified by the supplier. By providing your credit card to pay for travel services, you confirm that you will pay the total amount charged according to your cardholder agreement and agree not to initiate a chargeback. Should you initiate a chargeback for any reason, The Joy of Travel Ltd. reserves the right to take legal steps to recover any financial losses.
It is important to ensure that your payment method is valid and has sufficient funds before the final due date to avoid cancellation. Non-payment by the due date may result in automatic cancellation with full penalty. Extensions of final payment are not always available and are at the discretion of the supplier.
CANCELLATIONS
To cancel your booking, you must submit your request in writing by email to your Joy of Travel advisor. Cancellation fees will apply as per the supplier’s terms and conditions, which will be communicated to you at time of booking. Your reservation will not be cancelled until all applicable cancellation fees are confirmed and acknowledged.
No refund will be made for unused travel services or any unused portion of services for any reason. Any changes to your booking are subject to the terms and conditions of the tour operator, airline, cruise line, hotel, or other supplier involved.
CHANGES TO BOOKINGS
If you change your travel dates or alter your itinerary after confirmation, a change fee may apply from the supplier and/or The Joy of Travel Ltd. The type and scope of the change dictates the amount of the fee. You will be advised of any applicable fees at the time of the change request.
TRAVEL INSURANCE
We strongly recommend that you purchase comprehensive travel insurance at time of booking, covering trip cancellation, trip interruption, baggage, medical emergency, evacuation, repatriation, and other expenses which might arise as a result of loss, damage, injury, delay, or inconvenience. Insurance must be purchased for the entire duration of your trip. If you do not fully insure your trip, you may not be covered for certain losses.
Please note that some suppliers will only cover the air portion of your trip should they cancel. The land portion may be non-refundable and would need to be claimed under your travel insurance. All insurance claims are handled directly by the insurance provider. The Joy of Travel Ltd. has no involvement in the decision to accept or reject a claim.
The Joy of Travel Ltd. reserves the right to request proof of travel insurance prior to confirming any booking.
PASSPORTS, VISAS & TRAVEL DOCUMENTS
You are responsible for obtaining and ensuring that all necessary travel documents are valid and in your possession for the entire trip. A passport must be valid for at least six months after the scheduled date of departure from the last country visited. At least four blank pages are required for immigration stamps. Other required documents may include visas, permits, and vaccination certificates.
You assume complete and full responsibility for verifying all passport, visa, vaccination, and entry requirements for your destination. While we may provide general information on these matters as a courtesy, we are not responsible for any errors or omissions in that information. No refunds will be made for costs associated with documentation difficulties for any reason.
We recommend consulting Travel.gc.ca for up-to-date travel requirements issued by the Government of Canada.
HEALTH & VACCINATIONS
You are responsible for ensuring that all immunizations required to gain entry into your destination and to re-enter Canada have been obtained with necessary documentation. We recommend consulting a physician or travel health clinic at least 6-8 weeks prior to departure. Health information provided by The Joy of Travel Ltd. is for general guidance only and does not constitute medical advice. It is the traveller’s sole responsibility to comply with all health requirements for their destination.
Please be aware that some medications may be illegal in certain countries. It is your responsibility to know the rules prior to departure. See Travel.gc.ca for further guidance.
ENTRY REQUIREMENTS
Entry requirements vary by destination and can change at any time without notice. You may be required to show proof of vaccinations, negative COVID-19 tests, or other documentation depending on your destination. All entry and departure requirements, along with any country taxes or fees not included in the cost of your trip, are the traveller’s sole responsibility.
We recommend checking the Government of Canada’s travel advisories at Travel.gc.ca and verifying requirements directly with your destination country’s official sources prior to departure.
FLIGHTS & BAGGAGE
We recommend checking your airline’s website for check-in times and baggage allowances prior to departure. Baggage fees, advanced seat selection, airport transfers, and taxes may not be included in your travel pricing and are your responsibility. Some airlines oversell flights — pre-purchasing your seat assignment is recommended to reduce the risk of being bumped.
FLIGHT DISRUPTIONS
The Joy of Travel Ltd. acts as an intermediary between travellers and third-party suppliers including airlines, hotels, and tour operators. In the event of flight delays, cancellations, or schedule changes made by the airline, we will make every reasonable effort to assist with alternate arrangements based on airline policies and availability. However, The Joy of Travel Ltd. is not responsible for disruptions caused by the airline, nor do we guarantee the availability of replacement services.
If the airline offers a replacement flight and the traveller chooses not to accept it, this may be considered a voluntary cancellation. Refunds or credits in such cases are subject to the terms of the airline and other suppliers.
TRAVELLING WITH MINORS
It is the traveller’s responsibility to ensure that all rules pertaining to travel with a minor or unaccompanied minor are followed. A consent letter is recommended as per the Government of Canada. Children under the age of 2 at time of travel will be seated on a parent’s lap during flights unless a separate seat has been purchased.
CANNABIS & CROSS-BORDER TRAVEL
Taking cannabis or any product containing cannabis across Canada’s international borders is illegal and can result in serious criminal penalties both in Canada and abroad, regardless of the laws of the destination country. This applies to cannabis used for medical purposes as well. Previous use of cannabis or other substances prohibited by local law could result in a traveller being denied entry to their destination.
LOCAL LAWS, LIVING CONDITIONS & SAFETY
Travellers should be aware that different living standards, laws, and practices exist outside of Canada including but not limited to: provision of utilities, air conditioning, accommodations, services, food and food preparation, and water quality. The Joy of Travel Ltd. cannot guarantee the condition of any destination including safety, health, or climate conditions.
Safety is the responsibility of each individual participating in any activity or travel experience. Travellers are expected to exercise caution, act responsibly, and follow all safety instructions provided by guides, staff, or partners. Please note that certain destinations may impose temporary restrictions on the sale or consumption of alcohol during specific periods. These restrictions are outside our control and no refunds will be provided as a result.
FORCE MAJURE
The Joy of Travel Ltd. will not be liable for any delay or failure to perform obligations under this Agreement where such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, terrorism, war, civil unrest, strikes, government intervention, weather conditions, quarantine, epidemic, or pandemic. In such circumstances, The Joy of Travel Ltd. and/or its suppliers may vary or cancel any itinerary or arrangement at their sole discretion.
ACCURACY OF INFORMATION
The Joy of Travel Ltd. makes every effort to ensure the accuracy of information provided at time of booking. We reserve the right to correct any errors and to refuse or cancel bookings made at prices posted in error. The Joy of Travel Ltd. reserves the right to amend these Terms & Conditions at any time and any changes will be effective immediately upon posting to our website.
RESPONSIBILITY
The Joy of Travel Ltd. acts only as an intermediary for the various independent suppliers that provide lodging, meals, transportation, sightseeing, activities, insurance, or other goods and services connected with your trip. These suppliers are independent contractors and are not agents or employees of The Joy of Travel Ltd. A supplier’s services are subject to the supplier’s own terms and conditions and the local laws and regulations of the relevant country.
The Joy of Travel Ltd. is not responsible for any loss, damage, illness, injury, inconvenience, loss of enjoyment, anxiety, or fear arising from:
(A) The act, omission, or negligence of any travel service supplier.
(B) Theft, strike, lockout, mechanical failure, governmental restrictions, weather conditions, or any other cause beyond our control.
(C) A traveller’s failure to obtain or carry all required travel documents.
(D) A traveller’s failure to adhere to schedules or missed connections.
(E) Personal injury or death caused by a third-party supplier.
(F) Unauthorized statements or misrepresentations made by any third party relating to the standards, quality, or inclusions of travel services.
(G) Any claim not submitted to The Joy of Travel Ltd. in writing within 30 days of the completion of the relevant travel. No claim received after this period will be considered.
The Joy of Travel Ltd. shall not be liable for any indirect, incidental, consequential, or punitive damages of any kind, including but not limited to loss of enjoyment, emotional distress, loss of business opportunity, or any similar financial loss, even if The Joy of Travel Ltd. has been advised of the possibility of such damages.
In no event shall the total liability of The Joy of Travel Ltd. to the client exceed the total cost of the travel services actually paid to The Joy of Travel Ltd. for the specific booking giving rise to the claim, regardless of the nature or basis of the claim.
INDEMNIFICATION & HOLD HARMLESS
In consideration of The Joy of Travel Ltd. making a booking on your behalf, you agree to indemnify, defend, and hold harmless The Joy of Travel Ltd., its directors, officers, employees, and representatives from any and all claims, demands, damages, expenses, costs, or actions arising from your booking, your failure to obtain required documentation, or any act or omission by you or any member of your travelling party.
GOVERNING LAW
These Terms & Conditions are governed by the laws of the Province of Ontario and the Travel Industry Act, 2002. Any dispute arising from these terms shall be subject to the jurisdiction of the courts of Ontario.
SEVERABILITY
If any provision of this Agreement is found to be unenforceable or invalid under applicable law, such provision shall not render the Agreement unenforceable as a whole. All remaining provisions shall continue in full force and effect.
IMPORTANT: These Terms & Conditions are supplementary to the applicable supplier’s terms and conditions. Where there is any inconsistency, the provision more directly applicable to the issue at hand shall take precedence. All terms are subject to change with or without notice.
